1Acceptance of Terms

By creating an account, accessing, or using Grafty Send ("the Platform", "the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must immediately cease all access and use of the Service.

2Acceptable Use & Anti-Spam Policy

Grafty Send is built to facilitate legitimate, consent-based, and compliance-driven notification workflows. We enforce a zero-tolerance policy against spam, harassment, and unsolicited messaging.

  • You represent and warrant that all message recipients have explicitly opted in or consented to receive communications from you.
  • You are strictly prohibited from sending unsolicited bulk messages (spam), marketing messages without consent, phishing links, or content that violates local, state, or federal laws.
  • You agree not to use the Service to distribute adult, illegal, threatening, or defamatory material.

3WhatsApp Terms & Disclaimer

Grafty Send operates as an independent, third-party automation and notification gateway tool. We are not affiliated with, endorsed, sponsored, or associated with WhatsApp LLC, Meta Platforms, Inc., or any of their affiliates.

IMPORTANT: Account Actions & Suspension Risk

The use of automated tools and custom API integrations carries inherent risks, including the potential restriction, suspension, or permanent ban of your WhatsApp account by Meta/WhatsApp. Grafty Send has no control over WhatsApp's enforcement algorithms or policies. By using this service, you explicitly agree that you bear full responsibility and liability for your WhatsApp account, and Grafty Send will not be liable for any bans, loss of data, business disruption, or damages resulting from such account actions.

4Subscriptions, Billing & Payments

Grafty Send operates on a recurring subscription basis. Premium features, usage quotas, and account tiers are detailed on the Platform's pricing page.

  • Payment Processing: All transactions are securely processed through our certified third-party payment gateways (Stripe or Razorpay). We do not store your complete billing credentials on our servers.
  • Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless you explicitly cancel your subscription through your billing portal before the renewal date.
  • Refunds: Unless explicitly required by applicable consumer protection laws, all payments are non-refundable.

5Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GRAFTY SEND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL GRAFTY SEND, ITS FOUNDERS, OR TEAM BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION) ARISING FROM YOUR USE OF THE SERVICE, REGARDLESS OF THE LEGAL THEORY INVOLVED.

6Modifications to the Service & Terms

We reserve the right, at our sole discretion, to modify, update, or discontinue the Service (or any part thereof) with or without notice. We may also revise these Terms and Conditions periodically. Continued use of the platform following any modifications constitutes full acceptance of the updated terms.
